Welcome to Kineza Translate. By accessing or using our English to Kinyarwanda e-learning application, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Acceptance of Terms

By creating an account, downloading, or using Kineza Translate, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our services.

2. Description of Service

Kineza Translate is an e-learning platform designed to help users learn and translate between English and Kinyarwanda languages. Our services include:

• Interactive language lessons and courses
• Translation tools and resources
• Progress tracking and assessments
• Communication features for learning purposes
• Educational content and materials

3. User Accounts

3.1 Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

3.3 Age Requirements

Users under 13 years of age must have parental or guardian consent to use our services. By using the app, you confirm that you meet this requirement.

4. User Conduct

You agree not to:

• Use the service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe upon the rights of others
• Transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems

5. Intellectual Property

5.1 Our Content

All content, features, and functionality of Kineza Translate, including but not limited to text, graphics, logos, images, audio clips, and software, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the app for personal, non-commercial educational purposes only.

5.3 User Content

You retain ownership of any content you submit. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content for the purpose of providing and improving our services.

6. Subscription and Payments

If we offer paid features or subscriptions:

• Fees are charged in advance and are non-refundable except as required by law
• Subscriptions automatically renew unless cancelled before the renewal date
• We reserve the right to change pricing with advance notice
• You are responsible for all applicable taxes

7. Disclaimers and Limitations

7.1 Service Availability

We strive to provide uninterrupted service but do not guarantee that the app will be available at all times. We may suspend or discontinue any part of the service without notice.

7.2 Educational Content

While we strive for accuracy, we do not warrant that the educational content is error-free or complete. The app is provided for educational purposes and should not be the sole source of language learning.

7.3 "As Is" Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINEZA TRANSLATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

9. Termination

We reserve the right to suspend or terminate your account and access to the service at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms and Conditions
• Is harmful to other users, us, or third parties
• Violates applicable laws or regulations

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

10. Privacy

Your use of the service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

11. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify users of any material changes by posting the updated terms in the app and updating the "Effective Date" above. Your continued use after changes constitutes acceptance of the modified terms.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Rwanda, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these terms or your use of the service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration or in the courts of Rwanda.

14. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
